Welcome to Kazzzi! These Terms and Conditions ("Terms") govern your use of the Kazzzi mobile application (the "Service") provided by Kazzzi Inc. ("Kazzzi", "we", "us", or "our"). By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. The Kazzzi Service
Kazzzi is a technology platform that connects users seeking to obtain services ("Bosses") with users seeking to provide services ("Freelancers"). Bosses and Freelancers are collectively referred to as "Users".
IMPORTANT: Kazzzi is not a direct employer of Freelancers nor a direct provider of the gigs posted. Our role is to provide the platform to facilitate these connections. The actual contract for a service is directly between the Boss and the Freelancer. We are not a party to that contract.
2. User Accounts and Responsibilities
- Eligibility: You must be at least 18 years old and capable of entering into legally binding contracts to use the Service.
- Account Registration: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- Account Security: You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Gigs, Payments, and Fees
3.1. Posting Gigs (For Bosses)
As a Boss, you are responsible for providing accurate and complete details about the service you require, including the scope of work, location, and budget. By posting a gig, you agree to pay the agreed-upon amount for the service if it is completed to the specified requirements.
3.2. Proposals and Acceptance (For Freelancers)
As a Freelancer, you agree that your proposals will be submitted in good faith and that you possess the necessary skills and resources to complete the gigs you apply for. Once a Boss accepts your proposal, you are entering into a binding agreement with that Boss to perform the service.
3.3. Payment and Escrow
When a gig is assigned, the Boss must fund the agreed-upon amount into Kazzzi's secure escrow account. These funds will be held until the gig is marked as complete by the Boss or resolved through our dispute resolution process. Upon successful completion, the funds, less any applicable service fees, are released to the Freelancer's Kazzzi wallet.
3.4. Service Fees
Kazzzi may charge a service fee to both Bosses and Freelancers for using the platform. These fees will be clearly disclosed to you before you post or accept a gig. We reserve the right to change our service fees at any time.
4. User Conduct and Content
You are solely responsible for your conduct and any data, text, information, usernames, graphics, images, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links, and other content or materials that you submit, post, and display on the Service.
You must not engage in any fraudulent, abusive, or illegal activity. Kazzzi has a zero-tolerance policy for harassment, discrimination, and any form of unsafe conduct.
5. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Kazzzi, its affiliates, directors, employees, or its licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, this service.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
